These Terms & Conditions govern the use of our website solutions for small and medium-sized businesses in manufacturing, industrial, and factory sectors across India. By using our services, you agree to a seamless digital solution designed to enhance your online presence and accelerate business growth.
Scope of Work
We provide custom website development solutions for industrial businesses, including but not limited to:
- Chemical, Engineering, Construction, Manufacturing, Mining, Oil, Gas, Pharmaceuticals, Refineries, Metal Fabrication, and related industries.
- Customizable templates and industry-specific modules
- Essential business features such as product catalogs, service pages, project portfolios, testimonials, and career sections
- A Content Management System (CMS) for easy website management
- Business and administrative tools such as lead management, employee roles and permissions, and task tracking
- Complimentary domain and hosting for a seamless online presence
Clients receive centralized tools for website management. Additional customizations beyond pre-built solutions may incur extra charges.
Payment Terms
Payment Process- Full payment is required after selecting a package and before development begins
- Accepted payment methods: UPI and Bank Transfer (India) | Payment Gateway and Bank Transfer (International).
- Invoices and payment details will be provided upon package selection.
- If the project is canceled before development begins, a 50% refund is available.
- If 50% or more of the work has been completed, no refund is available.
- After full development, no cancellations or refunds will be provided.
- All prices include GST; no additional tax will be applied.
- Discount codes are displayed on the package page.
- Silver and Gold package renewals receive discounts; Platinum renewals do not.
Client Responsibilities
- Provide all required content (text, images, videos, etc.) in a timely manner.
- Ensure that submitted materials do not infringe copyrights, trademarks, or intellectual property rights.
- Obtain necessary licenses for third-party content used on the website.
- Comply with Indian IT laws, copyright regulations, and data protection policies.
- Do not upload illegal, defamatory, offensive, or prohibited content.
Delays in content submission may affect project timelines.
Revisions & Modifications
Revision Policy (Based on Package)- Silver Package: 1-2 revisions
- Gold Package: 3-4 revisions
- Platinum Package: 5-6 revisions
Revisions Cover:
- Minor text updates, image changes, and design tweaks
- Major structural changes (redesign, feature additions) may incur extra charges
- Clients must request revisions within 7 days of receiving the initial draft.
- Standard revision requests will be addressed within 5 business days.
Timeline & Delays
- The estimated project timeline depends on the selected package and scope of work.
- Delays may occur if the client fails to provide content, approvals, or feedback in a timely manner.
- If required materials are not submitted within a specified period, the project may be put on hold or incur additional fees.
- Urgent requests may be accommodated at an additional cost.
Ownership & Rights
- Upon full payment, the client owns the website content, design, and data.
- The client has the right to modify, update, or transfer the website
- The company retains the right to showcase the project in its portfolio, case studies, and marketing materials.
- Any custom-built software, proprietary tools, or licensed third-party elements remain the intellectual property of their respective owners.
- The client may not resell, redistribute, or claim authorship of proprietary code provided by the company.
Hosting & Maintenance
Hosting Services- Complimentary hosting is included in all website packages.
- Clients may choose external hosting, but the company is not responsible for performance or security issues in such cases.
Hosting Renewal
- Hosting must be renewed annually to avoid website suspension.
- Failure to renew may result in website deletion or data loss.
Maintenance
- Basic post-launch maintenance is provided for a specified period.
- Clients are encouraged to maintain backups of their website data.
- The company is not liable for security breaches, hacking, or malware attacks due to third-party integrations or client negligence.
Third-Party Services
- The company may integrate third-party plugins, APIs, and payment gateways.
- The functionality of third-party services depends on their respective providers, and the company is not liable for disruptions, pricing changes, or policy updates.
- Any additional licensing, subscription, or transaction fees are the client’s responsibility.
- The client must comply with third-party terms of use.
Warranty & Support
Warranty Period- A specified number of days post-launch, covering bug fixes and development-related functionality errors.
- The warranty does not cover third-party failures, client modifications, or security issues.
Ongoing Support
- Basic support is available during the warranty period.
- After warranty expiration, support is chargeable under a separate maintenance plan.
Limitation of Liability
The company shall not be liable for:
- Business losses, revenue loss, data loss, or reputational damage due to website usage.
- Cyberattacks, security breaches, or third-party service failures.
- Force majeure events such as natural disasters, regulatory changes, or global internet outages.
The client agrees to indemnify and hold the company harmless against any legal claims, damages, or liabilities arising from misuse of the website.
Compliance with Indian Laws
The company shall not be liable for:
- The client must ensure compliance with Indian IT laws, including the Information Technology Act, 2000, and data protection policies.
- The client must NOT use the website for:
- Illegal, fraudulent, defamatory, or obscene content
- Cybercrimes, hacking, phishing, or data theft
- Selling or promoting prohibited goods/services
If the client violates any law, the company reserves the right to suspend services without notice.
Termination
By the Client:- Can terminate with a written notice of a specified number of days.
- Refund applies ONLY if development has not started (50% refund).
- No refund if 50% or more work is completed.
By the Company:
- Can terminate for non-payment, policy violations, or illegal activities.
- No refunds for terminations caused by client violations.
After Termination:
- The client’s website and hosting will be deactivated.
- Reactivation may be possible with additional fees.
Governing Law
- These Terms & Conditions are governed by Indian law.
- Any disputes shall be resolved in the courts of the applicable city/state.
- Both parties agree to arbitration or mediation before pursuing legal action.
Agreement Acceptance
By engaging the company’s services, the client acknowledges, understands, and agrees to these Terms & Conditions.
